Amndar Terms of Service
These Terms of Service ("Terms") govern access to websites, applications, software, digital products and services provided by Amndar Limited ("Amndar", "we", "us", or "our").
By creating an account, purchasing a product or using an Amndar Service, a user agrees to these Terms. A particular Service may provide additional terms where necessary.
1. Services
Amndar develops and operates digital products and technology services. Services may contain free functionality and optional paid features, subscriptions, memberships, digital items, community features and other functionality.
2. Accounts
Users must provide accurate information where required and are responsible for protecting their account credentials and activity. Users must notify Amndar if they reasonably believe their account has been compromised.
Accounts must not be sold, transferred, misused or used to impersonate another person unless expressly permitted.
3. Acceptable Use
Users must not use a Service to:
- violate applicable law;
- harass, threaten, exploit or abuse another person;
- impersonate another person or organisation;
- commit or facilitate fraud;
- distribute malware or malicious code;
- gain unauthorised access to accounts, systems or information;
- interfere with Service security or operation;
- infringe intellectual-property or privacy rights;
- distribute unlawful material; or
- materially misuse a Service contrary to its intended operation.
4. Health, Fitness and Wellbeing Features
Some Services may provide exercise, fitness, activity, nutrition, recovery, wellbeing or related functionality. Unless expressly stated otherwise, such features are for general informational, tracking and fitness purposes and are not a substitute for professional medical diagnosis, treatment or advice.
Exercise and physical activity involve inherent risk. Users are responsible for deciding whether an activity is appropriate for their circumstances and should seek qualified professional advice where necessary.
Metrics and estimates generated by devices or software may be incomplete or inaccurate and should be interpreted accordingly.
5. User Content
Users retain ownership of their original content. By submitting content to a Service, the user grants Amndar the limited rights reasonably necessary to host, store, process, reproduce and display that content for operating and providing the Service.
Users must have the rights necessary to submit their content.
6. Community Interactions
Amndar does not guarantee another user's identity, honesty, qualifications, intentions or conduct. Users should exercise appropriate judgement and should never provide passwords, authentication credentials or sensitive financial information to another user.
Amndar may moderate, restrict or remove content and accounts where reasonably necessary under these Terms or applicable law.
7. Paid Features and Digital Items
Services may offer premium features, subscriptions, memberships, credits, seals, badges, cosmetic items, status items or other digital products.
The applicable price and material purchase terms will be displayed before purchase.
Unless expressly stated otherwise, a digital item:
- is not money or legal tender;
- is not cryptocurrency;
- is not an investment or ownership interest in Amndar;
- has no cash value outside the functionality expressly provided by the Service; and
- may not be transferred, sold or exchanged except where a Service expressly permits it.
8. Marketplace Purchases
Purchases made through an authorised application marketplace are subject to that marketplace's billing rules and payment terms.
The marketplace may process payment credentials. Amndar may receive transaction and entitlement information necessary to provide the purchased feature.
9. Subscriptions
Where a subscription is offered, the price, billing period and renewal terms will be displayed before purchase. Where automatic renewal applies, it will be disclosed.
Deleting an app or Amndar account does not necessarily cancel a marketplace subscription. Users should manage marketplace subscriptions through the controls provided by the applicable marketplace.
10. Refunds and Consumer Rights
Marketplace purchases may be subject to the marketplace's refund process.
Nothing in these Terms excludes, restricts or modifies rights, guarantees, remedies or liabilities that cannot lawfully be excluded, including rights that may apply under New Zealand consumer law.
11. Intellectual Property
Except for user-owned and third-party content, Amndar Services, software, branding, interface designs, systems, graphics and original content are owned by or licensed to Amndar and protected by applicable intellectual-property laws.
No ownership of Amndar intellectual property transfers to users under these Terms.
12. Third-Party Services
A Service may integrate with or link to third-party products, devices, websites or platforms. Third-party services operate under their own terms and privacy practices. Amndar is not responsible for their independent operation.
13. Availability and Changes
Amndar aims to provide reliable Services but does not guarantee uninterrupted or error-free operation. Services may change as products develop and may occasionally be unavailable due to maintenance, updates, infrastructure failures, security events or circumstances outside Amndar's reasonable control.
14. Suspension and Termination
Amndar may restrict, suspend or terminate access where reasonably necessary because of material Terms violations, fraud, abuse, security threats, unlawful conduct, risk to users or Services, or legal requirements.
15. Liability
Nothing in these Terms limits liability or rights that cannot legally be limited.
To the extent permitted by law, Amndar does not guarantee particular fitness, health, social, commercial or other outcomes from using a Service and is not responsible for loss caused solely by misuse of a Service or circumstances outside Amndar's reasonable control.
16. Governing Law
These Terms are governed by the laws of New Zealand, subject to mandatory rights a user may have under applicable law.
17. Changes
Amndar may update these Terms as its Services develop. The current version will be published through the official Amndar website or applicable Service. Material changes will be notified where required.
